Preamble

Inspired by the belief in the Almighty, filled with the gratitude to Our provincial regents, in the will that Our Empire last forever, in the responsibility towards Our people,

We, Comyr of Wettin, Emperor of the Holy Roman Empire of the German Nation, always ruler and defender of the Empire, for ever patron of the Holy Roman and Universal Aristotelian Church issue with the consent of Our provincial regents this constitution,

that they may give Our Empire prosperity and peace, strength and faith, contentment and happiness and secure him a glorious future.


I. Sacrum Romanorum Imperium Nationis Germanicӕ

Article 1

(1) The Holy Roman Empire of the German Nation (Sacrum Romanorum Imperium Nationis Germanicӕ, S.R.I.N.G.) , is a constitutional monarchy in the centre of Europe, with an Emperor chosen as ruler. The first duty of this empire is the protection of his subjects, his provinces and his kingdoms. As the guarantor of the only true Aristotelian Faith, the Emperor protects and preserves at any time the Holy City of Rome, the Holy Roman and Universal Aristotelian Church and the Occident against threats out of haresy and the Orient.

(2) Parts of this Empire are among many other territories especially the provinces:
- Archduchy Austria
- Duchy of Bavaria
- Duchy of Celje
- Duchy of Lorraine
- Duchy of Milan
- Duchy of Modena
- Duchy of Savoie
- Duchy of Styria
- Margraviate of Baden
- Principality of Mainz
- Franche-Comté
- County of Augsburg
- County of Holland
- County of Wurttemberg
- Burgraviate of Nuremberg
- Republic of Florence
- Republic of Genoa
- Republic of Siena

(3) At least two provinces can come together on a voluntary basis to form a kingdom, that is subordinated to the Emperor. Each kingdom is represented on imperial level by its king. A kingdom may be dissolved or modified at any time by the Emperor and has to give itself a constitution.

(4) The provinces and kingdoms is granted a high level of autonomy. Limitations may be made by this constitution or imperial laws, but should be kept to a minimum.

(5) Each Regent and every king has to swear an oath of allegiance to the Emperor to the start of his legacy to reaffirm the mutual support and cohesion of the Empire.


Article 2

(1) This constitution of the S.R.I.N.G. has the purpose to commit important structures and processes for all time. It may be changed only with the consent of a two thirds majority of the members of the Regents College and the Princes College as well as with the approval of the Emperor himself.

(2) This constitution is above any other law. Imperial laws are, with the exception of the constitution, above local laws, decrees and other regulations.

(3) The Lingua franca of the S.R.I.N.G. is English, insofar as an imperial institution is not limited to a common linguistic area. Mother tongues within the Empire are German, Italian, French, Dutch and Slovenian.


Article 3

(1) The state religion of the S.R.I.N.G. is the Aristotelian Faith, state church the Holy Roman and Universal Aristotelian Church.

(2) Further relations between the Empire and the Holy Roman and Universal Aristotelian Church are regulated within a concordat.


Article 4

(1) The Emperor holds the title Romanorum Imperator. His coat of arms is a black double-headed eagle on a golden background.

(2) The Emperor is the highest authority within the Empire. His power is only limited by this constitution and the laws resulting out of it.

(3) The imperial authority is transferred directly to the candidate who won the elections of a new Emperor. The Emperor cannot be suspended from his office until he resigns or dies. Therefore, the Emperor is inviolable and sacred.

(4) With the coronation the Emperor gets all imperial goods, institutions and possessions and the right to use them within the law.

(5) The Emperor's highest duty is to defend and protect his subjects against any threat and the preservation of the Empire itself.
For this purpose, the Emperor is especially allowed to:
- set up armies.
- commit each of his vassals with his sub-vassals to taking up arms. (Auxilium)
- modify any judgment of a court or anticipate every judgment, provided this is done in accordance with the contract of judges and the Emperor himself is not party of the dispute.
- release every provincial regent from his office in case of high treason and releases his vassals from their oaths.
- declare everyone an outlaw for a period of three months.
- exile everyone in the scope of the contract of judges.
- enact decrees, if they do not contradict existing laws and this constitution.


II. Legislative

Article 5

(1) The Imperial Diet represents the legislature of the Empire and is also an advisor to the Emperor. In addition, he has important control functions. He is lead by a president choosen by the Emperor.

(2) The Imperial Diet consists of up to three colleges. Each college has the task of initiative and reactive advice to the Emperor (Consilium), to exchange with other provinces and to strengthen the unity within the Empire and the founding of common traditions.

(3) The Regents College brings together all the provincial regents of the S.R.I.N.G.. With the support of two thirds of its members, the Regents College may determine the unconstitutionality and illegality of an imperial decision and suspend it.

(4) Members of the Princes College are all other direct vassals of the Emperor, except the immediate counts, viscounts/burgraves, barons/lords and knights. Immediate counts and viscounts get the right to speak in the college.

(5) If the Emperor governs over five or more Imperial Cities, a college of Imperial Cities has to be established, in which the respective mayors represent their cities. The status of an Imperial City can only be granted or revoked by the Emperor. The city is, independent of its links to a province, only subordinated to the Emperor.

(6) Each member of a college has one vote for each reason of membership. The accumulation of votes or the membership in more than on college is legal.

(7) The Emperor and the Imperial Council have the right to speak in all colleges. They do not have any votes in the Imperial Diet, even if they would have it as a member of one of the colleges.

( The Imperial Diet gives himself a statute for further regulations.


Article 6

(1) The Imperial Diet can pass laws in accordance with this constitution, that are valid for every citizen, vassal, and each person staying in the S.R.I.N.G. after being issued by the Emperor.

(2) Proposals for laws can be drafted and presented by the Emperor, his council or the member of a college. The Emperor and the colleges may also entrust a committee to prepare a draft of a law.

(3) Any law determines the achievable majority in the single colleges for change and repeal itself. If a law is enacted for the first time, it is necessary to achieve the majority, which is being considered for a change.

(4) The Emperor decides for himself, if he is ceding authority in the legislation to the Imperial Diet. Ceded authority can only be obtained again via the correspondingly required majorities.

(5) The Emperor has the right to veto against all passed laws, which he expresses by refusing his signature and non-remittal of the law.

(6) In the case of competing legislation, the older regulation is obligatory.

(7) The enactment of a new law, which restricts or extends regulations of an existing law is not permitted, if the required majorities are lower than that of the existing law.


Article 7

(1) As part of its suzerainty over all the territories of the Empire, the Emperor is allowed grant fiefs to citizens of the S.R.I.N.G..

(2) As far as worldly possessions within the Empire are assigned to an archdiocese or diocese, the Emperor grants these possessions to the archbishop or bishop, who is determined by the Holy Roman and Universal Aristotelian Church. By accepting this possessions, the respective dignitaries are obliged to consilium and there sub-vassals to auxilium.

(3) Further details are regulated within the imperial law of nobility.


III. Judiciary

Article 8

(1) The judicial power of S.R.I.N.G. consists of three levels. The Imperial Court forms after the Emperor the highest authority followed by the regional and national courts of appeal and the provincial courts.

(2) The interpretation of this constitution, and the laws of the Empire, is up to the Imperial Court.

(3) Further details are regulated within the imperial law of justice.


Article 9

(1) As high treason against the Emperor and the Holy Roman Empire is considered:
- the refusal of military aid (Auxilium) for the Empire,
- the non-recognition of the Emperor, his government or imperial laws,
- the attempt to change the structures of the state outside of the Imperial Diet,
- the reveal of state-supportive secrets
- the conscious action against imperial foreign and security policy,
- the blocking , impeding or non-execution of imperial decisions and
- the support of traitors in any form.

(2) High treason against the Empire is determined by the Emperor or a general court.

(3) A traitor loses his right of offices, dignities, titles, protection and obedience.


Article 10

(1) The cohesion of the S.R.I.N.G. is protected by Emperor's Peace.

(2) Further details are regulated within an imperial law.


IV. Executive

Article 11

(1) The Emperor is assisted by a council, which constitutes the government of the S.R.I.N.G.. He appoints and releases the Imperial Councillors for himself.


(2) The Emperor appoints a citizen of the S.R.I.N.G. as his Imperial Regent. He is in office until the election of a new Emperor. The Imperial Regent is the first adviser of the Emperor and speaks in his name. He represents the Emperor in case of absence, illness or death. Without the consent of the provincial regents, the Imperial Regent cannot declare war against other states, but is allowed to request military assistance (Auxilium) to defend the Empire against internal and external enemies. Withdrawl and allocation of fiefs by the Imperial Regent can only be done in case of throne vacancy and needs to be confirmed by the new Emperor. All other rights and obligations are taken over by the Imperial Regent without restriction.

(3) The Imperial Council consists in addition out of:
- the Imperial Spokesperson
- the Imperial Marshal
- the Imperial Chancellor
- the Imperial King of Arms
- the Imperial Chamberlain
- the Imperial Court Judge
- the Imperial Admiral
- the Imperial Church Advisor
- the Imperial Secretary
- the President of the Diet

(4) Each imperial councillor has to deal with his own office and has to build up a staff under certain circumstances. The tasks are allocated by the Emperor and are regulated in own statutes.

(5) All other offices of a councillor are suspended if possible, or have to been laid down. The Emperor can grant exceptions.

(6) Further councillors and offices within the Imperial Council are allowed.

Cassandre essayait d'être le plus souvent possible à la CDN, elle voulait montrer aux nobles de FC qu'elle était la, pour eux, le plus souvent que ses charges lui permettaient. Elle prit donc la peine de lire le texte en anglais, elle plissa des yeux et dit :

Si je traduis bien, cela donne:

Lorsque je lis la possibilité de l'Empereur suivante:

Dois-je comprendre que l'Empereur zigouille tout le monde, ou bien qu'il libère les nobles de la Province en question de leur serment envers le Régent, en ce sens qu'ils ne devront pas le servir? J'imagine le second cas, à moins que les nobles soient de connivence avec la régence...

Sinon, en somme, l'Empereur a le droit de déclarer hors la loi quiconque renverse un pouvoir en place, même si cela résulte d'une guerre civile, si je comprends bien.

En fait, c'est le sens du mot "release" qui me pose problème tout ça.

Bref L'Empire assoid son autorité...rien contre cela.
mais je m'interroge sur les conséquences que cela pourrait avoir.

Moi je traduis "everyone" par "tout le monde" mais bon quand je l'avais lu la première fois, je l'avais compris comme "toute personne" en tenant compte du contexte

"release" doit être compris comme une destitution du régnant... En clair, tout régnant agissant contre les intérêts de l'Empire sera destitué et ses vassaux libéré de leur serment d'allégeance.

Attention, en Diète quand on parle de "regent", on y entend le régnant donc pour la FC, le (la) Franc Comte(sse)

Cela a le mérite d'une plus grande cohérence... Et un plus par rapport au passé, la Diète obtient un réel pouvoir législatif.

Même si je ne suis pas d'accord avec tout... Mais j'ai donné mes avis positif et négatif déjà en Diète

Il y a beaucoup de changement par rapport à la précédente Magna Carta. Je suppose que le texte était sous les poussières au sein du Parlement vu qu'on en discutait aussi en Diète
